Is the US Attorney-General deliberately defying US law?

Attorney General Merrick Garland on Friday appointed U.S. Attorney David Weiss a special counsel in the Hunter Biden probe, as well as any other matters that arose or may arise from that investigation.

The appointment appears to be facially-illegal and Garland knows damn well that it is.

(a) An individual named as Special Counsel shall be a lawyer with a reputation for integrity and impartial decision making, and with appropriate experience to ensure both that the investigation will be conducted ably, expeditiously and thoroughly, and that investigative and prosecutorial decisions will be supported by an informed understanding of the criminal law and Department of Justice policies. The Special Counsel shall be selected from outside the United States Government.

Weiss cannot be appointed to this position as he is a sitting US Attorney!  It is explicitly unlawful under the CFRs for Garland to appoint him -- or any other sitting US Attorney.  By definition a "Special Counsel" must not be a person inside the US Government; that's the entire point of a Special Counsel!

This act by Garland is not only impeachable it is void as Weiss is not qualified and thus the appointment is an open, public, in-your-face fraud.

Where does this leave us as Americans?

Nowhere good -- and at some point we, as Americans, are going to have to deal with this problem whether we like it or not.

If Mr. Denninger is correct, this provides yet another grim perspective on my blog post earlier this morning concerning the "lawfare" being waged against President Trump.  Those behind it aren't just subverting the law - they're actively ignoring it.

As Karl Denninger said just this morning about the Fulton County charges:


The pattern we are in now is extremely dangerous and there is utterly no reason to believe it will stop here with Trump or this is a one-off; imprisoning political candidates as a means of preventing them from running for office is the sort of thing that gives rise to "an Austrian" and we are headed in that direction.

We would be wise to stop it right here and now while we still can within the boundaries of the law; we are not far from losing that option and once lost what's next nobody -- no matter which side of the aisle you're on -- wants.


And as for Merrick Garland . . . to think that he was nominated to become a Justice of the Supreme Court!  Given this latest demonstration of his respect for the law, one can only give devout thanks that he was not approved by the Senate for that position.  The country dodged a bullet there . . . but he's still doing as much damage as he can, by the looks of things.  It's worth remembering that President Obama nominated him to SCOTUS, and President Biden made him Attorney-General of the United States.  That tells us a great deal about both men, when you think about it.

  1. This is Garland's backlash to the senate scorning him. All dem's must be protected and all rep must be buried deep. Trump just happened to be the perfect fall guy.

  3. Garland's bent twords this kind of abuse had to have been known. He has been in DC far too long.

    I imagine that he was to extreme for even the RINOs and that is why McConnell blocked him.

  4. Sure, it is illegal and should not happen therefore... But it IS happening, and nothing is going to be done about it. "Opera non verba" if I am remembering the Latin correctly. Yes, people are talking about it and yelling... But not a single thing is actually being done about it. So, per usual they will get away with it.

  8. I was fired from a job after pointing out to my employer they were violating every DOT rule in the books. I filed grievance with both the feds and the proper Texas state authorities, and both refused to act. I eventually had to sue in federal court. As best I can tell ignoring or violating rules and regulations is the norm.

  10. To get right, all the AG had to do is fire Weiss. When push comes to shove, it will be revealed that there was a secret cocodil to the Wiess appointment that he was immediately terminated as a US Attorney upon acceptance of his appointment as Special Prosecutor. Shut up peasants! Problem solved.
